Privacy and Confidentiality Policy of TreeNomads

This Privacy Policy uses the definitions set out in the Terms and Conditions (“T&C”), to which we refer for clarification regarding the scope of defined terms.

Personal Data Protection

As part of its activities, the Proprietor collects general information about Users and Visitors of the Website and/or the App. Below, we describe the information that the Proprietor collects about its Users and Visitors and how it processes and uses such information.

A) Personal Database: The organised collection of personal data stored in a database owned by the Proprietor.

B) Personal Data: Any type of information referring to natural or legal persons who are Users of the Website and/or the App. This information includes name and surname, National Identity Document, identity card, passport, Tax Identification Number, user profile image, telephone number, email address, banking details, and credit card information. In each case, the mandatory data necessary for the proper use of the Website and/or the App will be specified.

C) Personal Data Owner: The User who provides their personal information to the Proprietor when registering as such.

D) Personal Data Processing: All operations and systematic resources, electronic or otherwise, that allow the collection, protection, management, storage, transformation, evaluation, isolation, and general processing of Personal Data.

2) Use of User Information

The Proprietor may use Personal Data for the following purposes:

A) Send messages or notifications via email regarding recent services, display banners, promotions, or advertisements of interest to our users, as well as updates about the Website and/or the App and/or Services. If the User wishes, they can request to be removed from promotional or advertising lists by sending an email to: treenomadsproject@gmail.com.

B) Send notifications via text messages to the mobile phone provided by the User. These text messages may contain information about the services offered on the Website and/or the App, including personal access codes for these services and reminders of payment due dates or other obligations.

C) Share Personal Data (including email address) with service providers or “subcontracting” companies that assist in improving or streamlining the operations of the Proprietor, such as payment processing or transport services. The Proprietor will make its best efforts to ensure that certain standards are met through agreements aimed at guaranteeing the privacy of User data. In some cases, these service providers may collect information directly from Users. In such cases, Users will be notified of the involvement of a service provider and will decide what information they wish to provide. If the User voluntarily provides additional information directly to these providers, they will be subject to their own privacy policies. The Proprietor is not responsible for the misuse of the User’s Personal Information by third-party companies or websites acting independently.

3) Legal Requirements

A) The Proprietor cooperates with competent authorities and third parties to comply with laws (e.g., fraud prevention, intellectual property rights protection). The Proprietor may disclose Personal Information under the order of government or judicial authorities for investigations, even if there is no formal court or administrative order, or in cases of criminal or fraud investigations. In such situations, the Proprietor is legally obligated to assist the authorities in clarifying the facts under investigation.

B) The Proprietor is not responsible for the use that Users or any other person may make of the published information.

4) Cookies

Users acknowledge and accept that the Proprietor will use search systems through the use of cookies. Cookies are files installed on the hard drive that store browsing information and have a limited duration. They help personalise services and may provide relevant content based on the User’s location. The Proprietor also offers certain functionalities that are only available through the use of Cookies.

The purpose of using Cookies is to understand the interests, location, and behaviour of our Users and Visitors who browse our Website, allowing us to better meet their needs. Additionally, it enables us to provide relevant, differentiated, or personalised information. The information collected via Cookies may also be used to analyse the pages visited by Users or Visitors, improve promotional and commercial strategies, display promotions or advertisements, provide updates about the Proprietor, display banners of interest, and enhance content and services.

Users acknowledge and agree that:

A) The Proprietor and/or any designated third party may request certain information that may be considered “Personal Data” under European data protection regulations, for commercial and advertising management purposes.

B) The Proprietor may engage third parties for the storage, organisation, modification, evaluation, blocking, and general processing of Personal Data.

5) Right of Access

Users’ Personal Data is protected by a password set by the User, allowing them to consult, review, correct, or delete their information using their user identification and password. Users may also request at any time that their data be deleted, corrected, or reviewed by contacting treenomadsproject@gmail.com.

Under European data protection laws, Users have the right to access their personal data free of charge at reasonable intervals. To do so, the applicant must provide proof of identity, such as a copy of their identification document.

If the data belongs to a legal entity, proof of representation must be provided. Once the identity and representation of the data owner are verified, the Proprietor will respond to the request within five (5) business days.

Users who access their data under this procedure may request its deletion, rectification, or updating, and the Proprietor is obligated to comply. However, the Proprietor may refuse to delete data when such deletion could harm the rights or legitimate interests of third parties or when there is a legal obligation to retain the data.

Retention of Personal Data

Personal Data collected through the Website and/or the App will only be retained by the Proprietor for a limited period. Users acknowledge and accept that the Personal Data provided will be deleted after this period, without any responsibility or obligation on the part of the Proprietor.

Privacy Policy Updates

The Proprietor reserves the right to make any changes or corrections to this Privacy Policy without prior notice. Therefore, Users are encouraged to review this Privacy Policy periodically.

Applicable Law and Jurisdiction

For the interpretation and/or compliance with these security, privacy, and legal terms, both Users and the Proprietor will be subject to European data protection laws and regulations, including the General Data Protection Regulation (GDPR). In case of any dispute, the parties agree to submit to the jurisdiction of the competent courts of the European Union, waiving any other jurisdiction that may correspond due to their present or future domicile or for any other reason.
